Understanding COCKOO Host’s Terms of Service

Greetings from COCKOO Host. By using any of COCKOO Host’s services, you consent to be bound by the following terms and conditions, which are referred to as the Terms of Service. All users of the COCKOO Host services, including browser users, vendors, customers, merchants, and/or content creators, are subject to these conditions.

COCKOO Host offers web hosting services to customers all over the world. It is our responsibility to safeguard each customer and deliver the finest services we can. By using COCKOO Host’s services and creating an account, you consent to abide by these Terms of Service as well as the company’s Acceptable Use Policy, Refund Policy, and Privacy Policy.

Customers understand that COCKOO Host’s services are of a kind wherein they may be interrupted for a variety of causes other than COCKOO Host’s carelessness and that it may be challenging to quantify the damages that may follow from such an interruption. Clients thus acknowledge and agree that COCKOO Host shall not be held responsible for any damages resulting from such causes outside of COCKOO Host’s direct and exclusive control.

  1. Indemnification

All COCKOO Host services are used at the client’s own risk. Specifically, COCKOO Host disclaims any merchantability and suitability for a particular purpose warranties. COCKOO Host disclaims all liability for any loss, data loss, or other commercial damage, including but not restricted to incidental, consequential, special, or other damages. In the event that any service is rendered, agreed to be rendered, or any product is sold by clients, agents, employees, or assigns, clients agree to defend, indemnify, save, and hold COCKOO Host harmless from all demands, liabilities, losses, costs, and claims, including reasonable attorney’s fees.  

Customers undertake to protect, indemnify, and hold COCKOO Host harmless from any liability resulting from harm to persons or property brought on by any goods or services offered for sale or distributed in association with COCKOO Host.

  1. Billing Policy

Depending on the service package selected, COCKOO Host provides customers with a variety of billing cycles, including monthly, quarterly, semi-annually, and annually. We provide a money-back guarantee for thirty days on a few hosting services. Refund requests will be evaluated on an individual basis and must be made via our approved support channels. Dedicated servers, certain promotional deals, and domain registration/transfer costs are not refundable. WeChat, Alipay, and cryptocurrency payments are not refundable, however, they can be credited to your account.

  1. Uptime Guarantee

There is a 99.9% uptime guarantee from COCKOO Host. Should we fall short of this standard of availability, the impacted customer might get credit in their account for the amount of downtime. In situations like DDoS attacks, planned maintenance, or any other situations outside of our reasonable control, credits for downtime are not applicable.

  1. Limitation of Liability

Should COCKOO Host servers go offline or become unavailable for any reason, COCKOO Host shall not be liable for any damages, including incidental and significant damages. Moreover, COCKOO Host disclaims all liability for any damages that may be claimed as a result of the removal or corruption of any web material from one of its servers. The instant cessation of service shall be the only form of compensation.

  1. Late Payments

A service will be suspended if it is not renewed within three days of the deadline. The service will end if it is not renewed within 14 days of the deadline. Reactivation is contingent upon backups being available and the outstanding balance being paid.

  1. Disclaimer

Data loss, failures, and system outages are not the responsibility of the COCKOO Host. In the event that any terms of service are broken, COCKOO Host alone has the authority to cancel, suspend, or terminate any service or client account, without prior notice or reimbursement. COCKOO Host reserves the right to modify any or all of the policies without prior notice and is not responsible for the conduct of its clients.

You agree to be bound by the terms of this agreement and to confirm having read and understood it before using any of COCKOO Host’s services.

By posting the updated terms on its website, COCKOO Host retains the right to change or alter any part of these agreements at any time.
